New York Rifle and Pistol Association Files Law Suit 

New York Gov. Andrew Cuomo said Wednesday that the state is not rolling back the nation’s most stringent gun control measure by keeping 10-bullet magazines legal, even though they would have been outlawed in a bill that passed this year. Cuomo and legislative leaders said after announcing a budget deal Wednesday night that they will continue to discuss changes in the law before a provision kicks in banning the sale of 10-bullet magazines.

The firearms ban outlaws the purchase of any magazines that carry more than seven bullets. This renders most legally owned handguns useless since manufacturers dont make nor do they plan on making 7 round magazines.  Most do make 10-bullet magazines for guns originally designed to hold 15 or more and all these magazines will be illegal when the gun ban law goes in effect on April 15.

Cuomo now says the state needs to allow the sale of handguns and rifles with 10-shot magazines, but law abiding New Yorkers will still be required to keep a maximum of seven bullets in them, except at shooting ranges and competitions.  Yes, you can have 10 rounds in your magazine when you train and practice but you are only allowed 7 rounds to defend yourself against criminals in New York.  Since when has ANY law stopped criminals from committing crime?  Cuomo and the legislature are putting law abiding, tax paying citizens at risk while helping criminals rape, rob, maim and  murder!  Good luck with all that, Cuomo. The citizens of New York are fighting back.

The New York affiliate of the National Rifle Association, sportsmens groups, firearms businesses and individual gun owners on Thursday requested an injunction to stop the states strict new gun control law enacted in the dark of night, without public hearings proscribed by law.

The federal suit, filed in Buffalo, said the law violates the constitutional rights of law-abiding citizens to keep commonly possessed firearms in the home for defense of self and family and for other lawful purposes.

The challenge takes aim at two key provisions of the law: a lower limit on magazine capacity and an expansion of the states assault weapons ban to include some popular and formerly legal semi-automatic rifles.

The New York State Rifle & Pistol Association, the lead plaintiff and NRA affiliate, said it was bringing the suit on behalf of its 45,000 members. President Tom King has estimated there are about 4.75 million gun owners among New Yorks 19 million residents. Other plaintiffs include the Westchester County Firearms Owners Association, Beikrich Ammunition Corp., Blueline Tactical & Police Supply, gun manufacturer Bedell Custom and the Sportsmens Association for Firearms Education.

Criminals have and use magazines without any limitation in capacity. The acts provisions on magazines put law-abiding citizens at a grave disadvantage to criminals, who will not comply with the seven-round limit, the suit said. Likewise, it said the ban on assault weapons, a pejorative term, is being broadened to describe countless numbers of rifles, handguns and shotguns that were commonly possessed under prior law.

UN Small Arms Treaty Negotiations Re-Open Today

Negotiations open at the United Nations in New York on the Arms Trade Treaty, which would require countries to determine whether weapons they sell would be used to commit serious human rights violations, terrorism or transnational organized crime.

The keys to the Arms Trade Treaty are in Obama’s hands. Last year the administration stalled negotiations following a campaign by law abiding gun owners in the United States. But this March left wing gun grabbing progressives have another chance to pass a treaty that will interfered with Second Amendment rights in America.

The National Rifle Association (NRA) has vowed to fight the international treaty to regulate the $70 billion global arms trade.  A drafting conference in July collapsed because gun owners in the U.S. and other nations put pressure on their elected officials to keep the U.N. from interfering with national sovereignty.

The Second Amendment of the U.S. Constitution protects the right to bear arms in the United States. The U.N. Small Arms Treaty could require the U.S. government to enact legislation to implement it, which would lead to unconstitutional restrictions on gun ownership.

U.N. delegates and gun-control activists say the July treaty negotiations fell apart largely because Obama, fearing attacks from Republican rival Mitt Romney before the Nov. 6 election if his administration was seen as supporting the pact.

We object to is the inclusion of civilian firearms within the scope of the treaty.  This is a treaty that really should address the transfer of large numbers of military weapons that leads to human rights abuses.

The treaty could infringe on gun rights guaranteed under the Second Amendment in the United States and could force the United States to participate in an international firearms registry.

The treaty, which has been years in the making, would cover battle tanks, artillery, combat aircraft, warships and missiles as well as small arms and light weapons. Global sales of conventional arms reach tens of billions of dollars annually, and the biggest players are the United States, China and Russia.

If you need another reason to oppose the treaty, officials at Amnesty International and other organizations said they were confident that China and Russia would support the final draft, which is expected to be negotiated next week.

The people are not to be disarmed of their weapons. They are left in full possession of them.

Schumer Bill Seeks to Criminalize Most Gun Transfers & Establish National Registration

We’ve read Chuck Schumer’s proposed Universal Background Check bill, and it is beyond ridiculous, even for a Progressive statist like Chuckles. Its gun transfer tyranny. PERIOD

The bill is overly broad, has some crazy penalties, and will result in government abuse and National Firearms registration, which will facilitate confiscation.  The full text of S. 374, the “Protecting Responsible Gun Sellers Act of 2013” is here .

The main provision of the bill is that any transfer of a firearm, no matter how fleeting, needs to go through an FFL and the transferee needs to have a background check performed through the NICS system.

There are few exceptions. In order to qualify for an exception to the rule of all transfers going through an FFL, the following requirements must be met:
The temporary transfer takes place at the owner’s house
The gun can’t be moved from the property
The transfer must last less than 7 days

There’s also a poorly worded exception for hunting and “sporting purposes,” as well as gifts to family members. What that means is if you go on a trip for more than 7 days and leave your guns at home unattended with a roommate, its now a felony under this law. And if I’m reading this right, this applies if you leave your guns with your spouse, but don’t transfer them as a gift.

There’s also no exception for lending guns to friends for the afternoon at their home or local range. I you loan guns to friends to try out before buying, you will have to transfer the gun through a FFL, than transfer it back, you guessed it, through an FFL with background fees paid both  ways.

It would be illegal to hand a firearm to someone other than the owner, effectively killing range trips with friends.

I quote from the bill the definition of “transfer” includes:
shall include a sale, gift, loan, return from pawn or consignment, or other disposition
Broad much? The only exception appears to be handing a gun to a potential buyer to evaluate and lending guns at a shooting range but ONLY IF:
at a shooting range located in or on premises owned or occupied by a duly incorporated organization organized for conservation purposes or to foster proficiency in firearms and the firearm is, at all times, kept within the premises of the shooting range;

So, only facilities where the stated purpose in the incorporation documents is conservation (hunting) or firearms proficiency. And if you’re shooting on your own private property, or on BLM land, ANY lending of guns EVEN IN THE PRESENCE OF THE OWNER for recreational shooting would be illegal.

As one of the provisions designed to “alleviate the fears” of the gun-owning public, it looks like there’s a provision in here that permanently sets the price of all FFL transfer fees to the same amount. That number will be set by the Attorney General, which these days is still Eric Holder. The current speculation is that this FFL fee will be used to do what the NFA tax was originally designed to do — make buying or transferring a gun so expensive that almost no one can do it.

In addition to the transfer requirements, it also makes it a federal felony to fail to report a lost or stolen firearm. If the gun isn’t reported to both local AND federal authorities within 24 hours, that’s a 5-year stretch in a federal pokey you just earned yourself.

The bill also specifically removes the ability for people with state permits to skip the NICS check. Currently in Texas, those with a concealed handgun license can purchase a gun without a NICS check as they’ve already passed a more stringent background check than NICS provides. This puts more strain on the FFL as well as the NICS system.

As written, this bill is a trainwreck. It creates felons out of people who may not have been aware that their roommate (on their month long trip through Asia) even owned a firearm, much less that there was one in the house.

It allows the government to regulate the price of background checks, enacting a mandatory fee (read tax) to be paid every time you want to exercise a right guaranteed by the Second Amendment, and lets the government set the fee at whatever level they choose with no recourse.

It also creates de facto registration through the NICS checks as well as the paperwork preservation requirements already in place.  

You don’t have to pay a fee to vote, as the supreme court ruled that unconstitutional. But for Chuck Schumer, its okay to charge a fee to exercise your Second Amendment right. And Eric Holder will tell you how much to pay.

Bloomberg vs the NRA - Gun Owners Will Decide the Winner

If you are a legal gun owner or plan on owning one, your number primary enemy is New York Billionaire Mayor McFacsit Michael Bloomberg.  He is the money behind  the gun banners, including both the Feinstein and Colorado gun grab.

Our Republic is being destroyed because the federal government and a handful of states have gone beyond the bounds of the Constitution.  This is what happens when we elect so called Progressives to national office.  Progressive is the politically correct (PC) term for Liberal Fascist.

Once the government has take away our Second Amendment civil rights, they will go after the First Amendment.  The term Liberal Fascist will be deemed hate speech, along with thousands of other prohibited words and phrases.  Saying proscribed words like Liberal Fascist will get your arrested.

Now before you send those emails calling me paranoid, crazy, a right wing-nut tea bagger, delusional, etc., take a look around the world.  The same countries that ban or severely restrict civilian ownership of firearms also have laws prohibting so called hate speech.  See Canada, England, Australia, and just about every country in the industrial world for details. 

The entire Bill of Rights is at stake.  Loose one, and we will loose them all.  Obama told you he was going to transform the Republic and hes intent on keeping that one promise.  Rachel Maddow is right about one thing (and only one thing). THERE ARE CONSEQUENCES TO ELECTIONS. When we elect Progressives intent on changing our Constitutional Republic into a statist socialized collective, this is what we get.

And if you own a firearm, you MUST be a MEMBER OF THE NRA.  Yes, there are many other excellent Second Amendment rights organizations out there. Im a member of half a dozen. But by far, the NRA is the MOST effective and successful lobby for defending our Second Amendment civil rights.  PERIOD.

There is no organization in America that the Left despises more than the NRA.  That is really all the proof you should need that the NRA is the most effective Second Amendment civil rights lobby in America.

News reports write about  “gun lobbyists” when referring to to the NRA but they call  the anti-gun lobbies gun safety groups or groups against gun violence.

The NRA is certainly a lobbying organization. As are unions, PACs, the Brady Bunch, Illegal Mayors against Guns, and thousands of citizen groups that band together for a common political purpose.

Liberal fascists claim the NRA is a puppet of gun manufacturers – nothing could be further from the truth.

Gun makers make money from the gun buying public. Without gun owners, there would be no commercial gun makers. The money does not come from the gun makers themselves, but from the gun-owning American public. If 100+ million legal American gun owners didn’t believe in the right of civilian gun ownership, they wouldn’t be spending billions of dollars on firearms, ammunition and accessories. Since Obama was elected 64 million of the 300 million civilian firearms in America have been sold.  Have you tried to buy a gun, a magazine or ammunition lately?  Good luck finding what you are looking to buy. The manufactures simply can not keep up with demand.

The primary problem is that not all gun owners appreciate the power of a concentrated voice. Yet the NRA has less than 5 million members out of 100 million gun owners.  If you are not part of the solution, you are part of the problem.

Progressives misrepresent.  They lie to get their way.  Obama, Biden and Feinstein keep describing small caliber modern sporting rifles as Military Assault Weapons and killing machines.  All firearms are machines and all firearms can kill.  In fact an AR15 .223 or 5.56 caliber round is at the LOW end of bullet size.

The Truth Behind Universal Background Checks 

The gun grabbers in the U.S. Senate are pushing for “universal background checks,”  because they know low information voters are in favor of requiring background checks for firearms buyers.  But the legislation is actually universal gun registration.

I was a law enforcement officer for over three decades and stand with America’s law abiding gun owners in opposition to this so called common sense legislation. 

Front Page Magazine recently reported on the consequences of universal gun registration in South Africa, which has resulted in widespread  genocide within eighteen short months of being enacted.

Like so many societies where demonstrating who’s in control becomes a necessity, disarming the population becomes a priority. In 2010, the ANC-led regime changed the Firearms Registration Act, demanding that all legal guns be re-registered by July 31, 2011. In the process of re-registration, more than half the applicants were turned down, and 90 percent were turned down again on appeal. Thus, white farm families were forced to relinquish their last line of defense against the tens of thousands of criminal gangs roaming the countryside–armed with AK47s. and as Genocide Watch noted on its website last July one more step was taken as well. “The government has disbanded the commando units of white farmers that once protected their farms, and has passed laws to confiscate the farmers’ weapons,” it reported. “Disarmament of a targeted group is one of the surest early warning signs of future genocidal killings.”

Universal gun registration laws are intended to disarm civilians.  Without gun registration and disarmament, the government of Russia the Holodomor would not have murdered out six to ten million Ukrainians and Germany’s armies would have met far greater resistance. If Germany had not disarmed the citizens,  extermination of Jews would have been far more difficult.

California, which requires firearms registration for law abiding citizens, is currently the only state that tracks and disarms people who have legally registered guns.  According to Attorney General Kamala Harris. Almost 20,000 gun owners who legally obtained their firearms in the state, may be prohibited from possessing firearms, because they are convicted felons, under a domestic violence restraining order or have been deemed mentally unstable.

Merely being in a database of registered gun owners and having a disqualifying event, such as a felony conviction or restraining order, isnt sufficient evidence for a search warrant, Marsh said March 5 during raids in San Bernardino County. So the agents often must talk their way into a residence to look for weapons, he said.

The no-gun list is compiled by cross-referencing files on almost 1 million handgun and assault-weapon owners with databases of new criminal records and involuntary mental-health commitments. About 15 to 20 names are added each day, according to the attorney generals office.

Harris is pushing for the Federal government to follow the California model for gun confiscation without due process.  Harris, a Democrat, has asked California lawmakers to more than double the number of agents assigned to seize firearms that were legally obtained by Californians. They seized about 2,000 weapons last year. Agents also confiscated 117,000 rounds of ammunition and 11,000 high-capacity magazines, according to state data.

Last year Canada ended its national long gun registry, a national database of every rifle and shotgun in the country that was supposed to help police track the movement of and sale of weapons. When it was introduced twenty years ago critics said the registration of firearms would eventually lead to confiscation, a criticism dismissed as ridiculous, yet that’s what happened right up until its dismantling.

 Yet Obama wants a “national database” of all firearms in the United States to “track the movement and sale of weapons.”  History shows that the database will lead to confiscation.  In December 2011, after the decision was made to end universal gun registration in Canada,  law abiding gun owners who had complied with the registry were having their rifles confiscated. In late 2011 hundreds if not thousands of people who had legally purchased the Armi Jager AP80, a .22 calibre variant of the AK 47, were informed that their rifles had been deemed illegal and must be surrendered to the government.

The decision to reclassify what for years had been a legal rifle was made by a bureaucrat not by elected officials. There was no debate, no vote just a decision by a bureaucrat who felt the AP80, legally owned for decades, was too dangerous to be privately owned by Canadians.  A bureaucrat decided that the AP 80 looked too similar to the AK47. There were no interchangeable parts between the two rifles, the rifles used different ammunition but looked similar.
